Stacked reserves the right to change these terms and conditions at any time without notice.


STACKED REWARDS – LOYALTY PROGRAM

  1. By using or registering for the Stacked Rewards program, you consent to these terms and conditions.
  2. To receive any benefits from the Stacked Rewards program, you are required to be registered and to provide Stacked with a valid email address.
  3. No fees are charged by Stacked for the issue, registration, activation or use of the Stacked Rewards membership program. Stacked accepts no responsibility on any expenses that may be incurred in accessing and using a Stacked website or app.
  4. Stacked accepts no responsibility for incorrect information provided by anyone registered for the Stacked Rewards program.
  5. Stacked accepts no responsibility for inability to access a Stacked website or app due to incompatible hardware or software.
  6. If any employee of Stacked considers a Stacked Rewards membership fraudulent, it will be terminated as soon as possible and will not able to be used.
  7. If an error has occurred with a Stacked Rewards membership, Stacked reserves the right to change the balance. While all reasonable effort will be made in Stacked stores for points to be correctly given, Stacked takes no responsibility for errors that may occur with Stacked Rewards points and/or Stacked Dollars.
  8. If a Stacked Rewards login is lost or stolen, it will not be replaced or refunded. Stacked does not accept any liability for a lost or stolen Stacked Rewards membership.
  9. Stacked Dollars are the equivalent amount of credit that is available for redemption at any participating Stacked store. It is not legal tender and cannot be redeemed for cash or used anywhere other than a participating Stacked store.
  10. Stacked Dollars retain their value and do not gain interest or increase in value.
  11. The Stacked Rewards membership cannot be used with Stacked catering orders.
  12. As of 09/09/2020, a Stacked Rewards member can earn 10 Stacked Dollars for every 150 Stacked Rewards points.
  13. As of 09/09/2020, 1 (one) Stacked Rewards point can be earned for each AU$1 spent in store. Points can only be earned where a customer’s unique Stacked Rewards code is successfully scanned at a Stacked store.
  14. As of 09/09/2020, Stacked Dollars can be spent on any food or drink at any Stacked store at a rate of 1 (one) Stacked dollar to AU$1.


VOUCHERS FOR FREE PRODUCT, DISCOUNTED PRODUCT OR BONUS STACKED REWARDS POINTS

  1. By using a Stacked voucher, you agree to these terms and conditions.
  2. Any Stacked voucher can only be used or redeemed once.
  3. You must present your voucher code at any participating Stacked store to receive the offer.
  4. Stacked vouchers cannot be redeemed for cash or credit, unless specified.
  5. Stacked vouchers for free product cannot be used in conjunction with any other offer or promotion.
  6. Stacked vouchers cannot be sold.
  7. The person redeeming the voucher may be liable to pay any amount outstanding after the voucher has been applied.
  8. Stacked Rewards points will only be applied to any amount paid in addition to the voucher. If no amount is paid, no Stacked Rewards points will be earned.


GIFT CARDS

  1. Purchase or use of a Stacked Gift Card constitutes acceptance of these terms and conditions by the person in possession of the card, regardless of who originally purchased the Stacked Gift Card.
  2. A Stacked Gift Card allows you to pre-purchase credit to be used only in Stacked stores.
  3. A Stacked Gift Card retains the value purchased at the time it was originally purchased, and does not gain interest or increase in value.
  4. Stacked Gift Cards cannot be purchased with Stacked Rewards points.
  5. Stacked Rewards points can be earned for purchases made using the Stacked Gift Card.
  6. Stacked does not provide any statements or transaction history for Stacked Gift Cards. The balance of a Stacked Gift Card can be checked at any Stacked store upon presentation of the Stacked Gift Card to a Stacked employee.
  7. A Stacked Gift Card is non-refundable and cannot be redeemed for cash.
  8. If a Stacked Gift Card is lost or stolen, it will not be replaced or refunded. Stacked does not accept any liability for a lost or stolen Stacked Gift Cards.
  9. A Stacked Gift Card cannot be used in conjunction with any other offer by or on behalf of Stacked.
  10. If an error has occurred with a Stacked Gift Card, Stacked reserves the right to change the balance.
  11. If any employee of Stacked considers a Gift Card fraudulent, it will be destroyed immediately and is not able to be used.


ONLINE ORDERING

  1. By submitting an order through a Stacked website or app, you agree to these terms and conditions.
  2. Stacked accepts no responsibility for inability to access a Stacked website or app due to incompatible hardware or software.
  3. If you are not satisfied with a particular item, please let us know, within 48 hours, by telephone
    or email with as much detail as possible. An investigation will be performed with the relevant
    Stacked store and if deemed appropriate by Stacked, an award may be given.
  4. Stacked accepts no responsibility for incorrect information provided by the orderer. By creating an account or submitting an order, all information submitted is to be assumed to be true and correct. Please ensure that you check all details entered before submitting your order, as it will be processed immediately upon submission.
  5. When placing a catering order, orders must be placed by 12:00pm the day before delivery is required. Stacked will only accept catering orders within the zone advertised on the Stacked catering website.
  6. Orders cannot be cancelled or modified unless it is a catering order. Any cancellations or modifications to a catering order must be placed by 12:00pm the day before delivery is required. We will send you a written confirmation of accepting the order cancellation or modification. If you do not receive written confirmation, the order is deemed to not have been cancelled or modified.
  7. If Stacked is unable to fulfil your order due to unforeseen circumstances, whether in part or in full, Stacked will contact the orderer to cancel or modify the order.
  8. To pickup an order from the selected store, the orderer must present the order confirmation and, if a Stacked staff member deems necessary, proof of identification.
  9. All orders are prepared in expectation of the pickup or delivery time specified by the orderer. Stacked does not accept any responsibility for quality of food should the pickup or delivery occur outside of a reasonable period of time, beyond that specified by the orderer.
  10. The Stacked Rewards program cannot be used with Stacked catering orders.
  11. Stacked reserves the right to not accept any order on any grounds.
  12. Stacked reserves the right to change pricing on any Stacked website or app at any time without notice.


REFERRAL PROGRAMS

  1. Where Stacked allows you to provide the personal and contact details of another person, you warrant that the person has consented to their information being provided to Stacked, and to being contacted by Stacked.
  2. You indemnify Stacked, its officers, representatives, employees, contractors, servants, directors and agents against all actions, claims and demands (including the cost of defending or setting aside any actions, claims and demands) arising out of or in respect of sending an email or other communication method, or any contravention of the SPAM Act 2003.
